On a bilateralist reading, sequents are interpreted as statements to the effect that, given the assertion of the antecedent it is incoherent to deny the succedent. This interpretation goes against its own ecumenical ambitions, endowing Cut with a meaning very close to that of tertium non datur and thus rendering it intuitionistically unpalatable. This paper explores a top-down route for arguing that, even intuitionistically, a prohibition to deny is as strong as a licence to assert.

Over the past fifteen years there has been a considerable amount of debate concerning what theoretical population dynamic models tell us about the nature of natural selection and drift. On the causal interpretation, these models describe the causes of population change. On the statistical interpretation, the models of population dynamics models specify statistical parameters that explain, predict, and quantify changes in population structure, without identifying the causes of those changes. Selection and drift are part of a statistical description of population (...) change; they are not discrete, apportionable causes. Our objective here is to provide a definitive statement of the statistical position, so as to allay some confusions in the current literature. We outline four commitments that are central to statisticalism. They are: 1. Natural Selection is a higher order effect; 2. Trait fitness is primitive; 3. Modern Synthesis (MS)-models are substrate neutral; 4. MS-selection and drift are model-relative. (shrink)

What is Life? This is the question asked by Denis Noble in this very personal and at times deeply lyrical book. Noble is a renowned physiologist and systems biologist, and he argues that the genome is not life itself: to understand what life is, we must view it at a variety of different levels, all interacting with each other in a complex web. In evolutionary biology changes in population structure are explained by citing trait fitness distribution. I distinguish three interpretations of fitness explanations—the Two‐Factor Model, the Single‐Factor Model, and the Statistical Interpretation—and argue for the last of these. These interpretations differ in their degrees of causal commitment. The first two hold that trait fitness distribution causes population change. Trait fitness explanations, according to these interpretations, are causal explanations. The last maintains that trait fitness distribution correlates with population change but does not cause (...) it. My defense of the Statistical Interpretation relies on a distinctive feature of causation. Causes conform to the Sure Thing Principle. For modern 'systems biology' considers life on a variety of levels, as an intricate web of feedback between gene, cell, organ, body, and environment. He shows how it is both a biologically rigorous and richly rewarding way of understanding life.

Denis McManus presents a novel account of Martin Heidegger's early vision of our subjectivity and the world we inhabit. He explores key elements of Heidegger's philosophy, and argues that Heidegger's central claims identify genuine demands that must be met if we are to achieve the feat of thinking determinate thoughts about the world around us.

Executive functioning has been said to bear on a range of traditional philosophical topics, such as consciousness, thought, and action. Surprisingly, philosophers have not much engaged with the scientific literature on executive functioning. This lack of engagement may be due to several influential criticisms of that literature by Daniel Dennett, Alan Allport, and others. In this paper I argue that more recent research on executive functioning shows that these criticisms are no longer valid. ABSTRACT:In a series of reports the United Nations Special Representative on the issue of Human Rights and Transnational Corporations has emphasized a tripartite framework regarding business and human rights that includes the state “duty to protect,” the TNC “responsibility to respect,” and “appropriate remedies” for human rights violations. This article examines the recent history of UN initiatives regarding business and human rights and places the tripartite framework in historical context. Three approaches to human rights are distinguished: moral, political, and legal. (...) It is argued that the tripartite framework’s grounding of the responsibility of TNCs to respect human rights is properly understood as moral and not merely as a political or legal duty. A moral account of the duty of TNCs to respect basic human rights is defended and contrasted with a merely strategic approach. The main conclusion of the article is that only a moral account of the basic human rights duties of TNCs provides a sufficiently deep justification of “the corporate responsibility to respect human rights” feature of the tripartite framework. We review recent developments in ethical pluralism, ethical particularism, Kantian intuitionism, rights theory, and climate change ethics, and show the relevance of these developments in ethical theory to contemporary business ethics. This paper explains why pluralists think that ethical decisions should be guided by multiple standards and why particularists emphasize the crucial role of context in determining sound moral judgments. We explain why Kantian intuitionism emphasizes the discerning power of intuitive reason and seek to integrate that with the comprehensiveness of (...) Kant’s moral framework. And we show how human rights can be grounded in human agency, and explain the connections between human rights and climate change. (shrink)

In “Sweatshops and Respect for Persons” we argued on Kantian grounds that managers of multinational enterprises (MNEs) have the following duties: to adhere to local labor laws, to refrain from coercion, to meet minimum health and safety standards, and to pay workers a living wage. In their commentary on our paper Sollars and Englander challenge some of our conclusions. We argue here that several of their criticisms are based on an inaccurate reading of our paper, and that none of the (...) remaining criticisms successfully challenge our main arguments. By highlighting the shortcomings of their arguments we hope to advance discussion of the ethical treatment of workers in global supply chains. (shrink)

ABSTRACT:Little theoretical attention has been paid to the question of what obligations corporations and other business enterprises have to the four billion people living at the base of the global economic pyramid. This article makes several theoretical contributions to this topic. First, it is argued that corporations are properly understood as agents of global justice. Second, the legitimacy of global governance institutions and the legitimacy of corporations and other business enterprises are distinguished. Third, it is argued that a deliberative democracy (...) model of corporate legitimacy defended by theorists of political CSR is unsatisfactory. Fourth, it is argued that a Rawlsian theoretical framework fails to provide a satisfactory account of the obligations of corporations regarding global justice. Finally, an ethical conception of CSR grounded in an appropriately modest set of duties tied to corporate relationships is then defended. This position is cosmopolitan in scope and grounded in overlapping arguments for human rights. (shrink)

The purpose of this book is to highlight Carl Stumpf's contributions to philosophy and to assess some of the aspects of his work. This book brings together several specialists of Stumpf and the school of Franz Brentano, and includes fourteen original studies (in English and German) on the various aspects of Stumpf's philosophy, and some of his unpublished writings. This book is divided into four sections, and also includes a general introduction on the reception and actuality of Stumpf's philosophy. The (...) first section examines the historical sources of his philosophy, the second examines some of the central themes of his work and the third examines his relationship to other philosophers. The fourth section consists of notes taken by Husserl during Stumpf's lectures on metaphysics in Halle, Stumpf's introduction to the edition of his correspondence with Brentano, which he prepared in 1929, and some important letters pertaining to this correspondence. The dual character of invariance under transformations and definability by some operations has been used in classical works by, for example, Galois and Klein. Following Tarski, philosophers of logic have claimed that logical notions themselves could be characterized in terms of invariance. In this article, we generalize a correspondence due to Krasner between invariance under groups of permutations and definability in L∞∞ so as to cover the cases that are of interest in the logicality debates, getting McGee’s theorem about quantifiers (...) invariant under all permutations and definability in pure L∞∞ as a particular case. We also prove some optimality results along the way, regarding the kinds of relations which are needed so that every subgroup of the full permutation group is characterizable as a group of automorphisms. Libertarian theories of the normative core of the corporation hold in common the view that is the responsibility of publicity held corporations to return profits to shareholders within the bounds of certain moral side-constraints. Side-constraints may be either weak (grounded in the rules of the game) or strong (grounded in rights). This essay considers libertarian arguments regarding the normative core of the corporation in the context of global capitalism and in the light of actual corporate behavior. First, it is argued (...) the weak side-constraints view is conceptually incoherent when applied in a global context. Second, it is argued that proponents of the libertarian strong side-constraints view lack an adequate theory of rights. Third, both the weak side-constraints view and the strong side-constraints view are shown to be unsatisfactory insofar as they fail to adequately address the coercive power of corporations. The main conclusion of this essay is that a viable libertarian theory of the corporation has yet to be articulated. (shrink)

In this dissertation I develop a general theory of coercion that allows one to distinguish cases of interpersonal coercion from cases of persuasion or manipulation, and cases of institutional coercion from cases of oppression. The general theory of coercion that I develop includes as one component a theory of second-order coercion. Second-order coercion takes place whenever one person intentionally impairs the formation of the second-order desires of another person, or constrains them after their formation, in a way that frustrates or (...) eliminates the possibility of the victim fulfilling certain of his or her first-order desires. The concept of second-order coercion is important because it suggests that a person's autonomy may be violated in ways that have not been previously recognized. In this dissertation I argue that the unique feature of all cases of coercion is that the alternatives available to the victim, with regard to the formation of his or her will, are intentionally constrained by another person in a way that violates the victim's autonomy. A general theory of coercion should be able to explain how institutions may be understood as coercive. I argue that if institutions are understood as social practices maintained for the purpose of achieving some end, then they may be properly understood as capable of coercion. ;This theory of coercion allows me to make two arguments concerning moral responsibility. First, I argue that current discussions of moral responsibility are inadequate because they fail to take seriously the claim that a person may be responsible, at least in part, for having the beliefs and desires that make a particular action a case of coercion. Second, I argue that discussions of moral responsibility are inadequate because they fail to recognize that an agent may not be responsible for the state of his or her will because he or she may have been coerced in a way that has not been previously recognized. For example, biology has been used to justify eugenic programs, forced sterilization, human experimentation, and death camps—all in an attempt to support notions of racial superiority. Despite its importance in various fields, analogical reasoning has not yet received a unified formal representation. Our contribution proposes a general scheme of inference that is compatible with different types of logic (deductive, probabilistic, non-monotonic). Firstly, analogical assessment precisely defines the similarity of two objects according to their properties, in a relative rather than absolute way. Secondly, analogical inference transfers a new property from one object to a similar one, thanks to an over-hypothesis linking two sets of properties. This special issue focuses on the theoretical, empirical and practical integrations between embodied cognition theory and educational science. The key question is: Can EC constitute a new theoretical framework for educational science and practice? The papers of the special issue support the efforts of those interested in the role of EC in education and in the epistemological convergence of EC and educational science. They deal with a variety of relevant topics in education and offer a focus on the role of (...) the body and embodied experience in learning and educational settings. In conclusion, some further topics are suggested that will need to be investigated in the future, such as a critical evaluation of the possibility for an epistemological alliance between educational theory and embodied cognition, and the contribution that enactive cognition can provide to educational systems, organizations, institutions and policies. Brentano’s metaphysical position in Psychology from an Empirical Standpoint is usually assumed to be metaphysical realism. I propose an alternative interpretation, according to which Brentano was at that time, as well as later, a full-fledged phenomenalist. However, his phenomenalism is markedly different from standard phenomenalism in that it does not deny that the physicist’s judgments are really about the objective world. The aim of the theory of intentionality, I argue, is to allow for extra-phenomenal aboutness within a phenomenalist framework.

This article looks at the term dharma as used in a ivth century Indian Buddhist text, the Dharmadharmatāvibhāga. The difficulties of translations mentioned by several translators are a symptom of a problem of the interpretation and touch upon the function of such terms. We are therefore faced with a philosophical problem where philosophy itself is praxis.

The primary concern of this paper is Hume's account of the moral difference between humans and other animals. In order to clarify this difference Hume's views regarding reason, sympathy, and human sentiment are examined. The purpose of this investigation is threefold. First, Hume's position on the moral difference between humans and other animals is clarified. It is argued that this difference is properly traced to Hume's account of the sentiment of humanity. Second, Hume is defended against the claim that his (...) position on this matter is inconsistent. Third, it is argued that Hume's theory of morality leaves open the possibility that some earthly species other than our own may be properly understood as moral. (shrink)

This paper identifies a problem that Aristotle revealed and that Heidegger’s own insights, into the diverse forms that the Being of entities takes, exacerbated: the problem is whether there is sense to the idea of ‘Being in general’—‘Being as a whole’—and this is a problem because there not being such sense threatens the very possibility of the discipline of ontology. The paper proposes that Heidegger envisaged the project which a completed Being and Time would have carried out as an attempt (...) to solve this problem. The project considers what the subject who intends ‘Being as a whole’ would have to be like; crucially this requires reflection on what it would be for that subject itself to be a whole; and we find such reflection in Heidegger’s discussion of authenticity. By looking in particular at his notions of ‘guilt’ and ‘Being-towards-death’, and the role that they play in identifying an ‘ecstatic’ form of temporality, we can identify a ‘horizon’ against which the authentic can be seen as ‘being-a-whole’ and as living in the light of an understanding of what might indeed be called ‘Being as a whole’. Resumo: O objetivo central deste artigo é procurar compreender a concepção normativa híbrida usada por John Rawls para justificar moralmente a punição legal, fazendo uso de um recurso consequencialista, a fim de justificar a instituição da punição, isto é, a eficácia social e um recurso retributivista para justificar os atos punitivos particulares, ou seja, a culpa do agente. Analisaremos, especialmente, o artigo "Two Concepts of Rules" e o livro A Theory of Justice. Defenderemos que Rawls faz uso de uma visão (...) liberal de punição, bem como utiliza o método de equilíbrio reflexivo, estipulando uma regra para aprovação da punição legal, a partir da coerência com nossos juízos morais ponderados, o que parece reconciliar a justiça retributiva com a justiça distributiva.2: The principal aim of this paper is to understand the hybrid normative concept used by John Rawls to morally justify legal punishment. Rawls uses a consequentialist argument - that is, social efficacy - to justify the institution of punishment, and a retributivist argument - that is, the guilt of the agent - to justify particular acts of punishment. The article "Two Concepts of Rules" and the book A Theory of Justice are analyzed. We argue that Rawls uses a liberal view of punishment, as well as the method of reflective equilibrium, stipulating a rule for approval of legal punishment based on its coherence with our considered moral judgments; this seems to reconcile retributive justice with distributive justice. This paper forms part of a research project investigating conceptions of the relationship between micro-level self-seeking agent behaviour and the desirability or otherwise of the resulting macro-level social outcomes in the history of economics. I identify two kinds of conservative rhetorical strategy, characterised by reductionism, and by holism plus an invisible hand mechanism, respectively. The present paper extends this study to Malthus, focusing on the various editions of his Essay on Population and his Summary View of the Principle of Population. (...) Like the reductionist (Friedman, Lucas) and holistic (Smith, Hayek) proponents of laissez-faire, Malthus, too, is a defender of ‘the present order of things’ and an advocate of dependence on spontaneous forces. Malthus starts out within the eighteenth-century providentialist paradigm epitomised by Adam Smith and Dugald Stewart, but he later abandoned providentialism, adopting a more reductionist standpoint. Like Smith and Stewart, he takes a conservative political stance and opposes radical reform of society. But in taking up the arguments of the leading reformers of the day, Godwin and Condorcet, he is drawn by the logic of his argument to a position very far removed from Smith’s stoic optimism. The weapon he deploys against the reformers is the principle of population, by means of which he is able to portray the present state of society as something natural, eternal and inevitable, something in common with the animal and vegetable kingdoms. Though a potent weapon against the utopians, at the same time the principle of population undermines providentialism In the First Essay he tries to mitigate this by presenting a theodicy to reconcile his theory with a version of providentialism, but within weeks of publication he begins work on its replacement, a secular and reductionist argument that individual self-interest can guide us to socially desirable outcomes. This thesis argues for the fundamental importance of the opposition between holistic and reductionistic world-views in economics. Both reductionism and holism may nevertheless underpin laissez-faire policy prescriptions. Scrutiny of the nature of the articulation between micro and macro levels in the writings of economists suggests that invisible hand theories play a key role in reconciling reductionist policy prescriptions with a holistic world. An examination of the prisoners' dilemma in game theory and Arrow's impossibility theorem in social choice theory sets the (...) scene. The prisoners' dilemma epitomises the collective irrationality coordination problems lead to. The source of the dilemma is identified as the combination of interdependence in content and independence in form of the decision making process. Arrovian impossibility has been perceived as challenging traditional views of the relationship between micro and macro levels in economics. Conservative arguments against the possibility in principle of a social welfare function are criticised here as depending on an illicit dualism. The thesis then reviews the standpoints of Smith, Hayek and Keynes. For Smith, the social desirability of individual self-seeking activity is ensured by the 'invisible hand' of a god who has moulded us so to behave, that the quantity of happiness in the world is always maximised. Hayek seeks to re-establish the invisible hand in a secular age, replacing the agency of a deity with an evolutionary mechanism. Hayek's evolutionary theory, criticised here as being based on the exploded notion of group selection, cannot underpin the desirability of spontaneous outcomes. I conclude by arguing that Keynes shares the holistic approach of Smith and Hayek, but without their reliance on invisible hand mechanisms. If spontaneous processes cannot be relied upon to generate desirable social outcomes then we have to take responsibility for achieving this ourselves by establishing the appropriate institutional framework to eliminate macroeconomic prisoners' dilemmas. For many economists, including those who have made the most marked contribution to the development of the discipline, their work has to be understood in the context of the rhetorical strategy they were pursuing – what they wanted to persuade us of and how they wanted to do it. The paper identifies two fundamental rhetorical strategies of laissez-faire resting on entirely distinct ontological foundations. What distinguishes these two strategies is the way they articulate the individual with the general interest, how (...) they relate the micro to the macro. The two strategies discussed in the paper are characterised by the stance they take on a fundamental ontological issue, the way in which the things which appear to us in the world are related to the things or matters which compose them. A reductionist approach suggests that we can understand an entity at one level as a congeries. An entity in this view is just an aggregate of entities at a lower, substrate level – a purely external unity. The properties and behaviour of an entity can then be understood in terms of the properties and behaviour of the constituent lower-level components, taken in isolation. In this approach, phenomena at some level are regarded as having just the qualities enjoyed by its lower-level, substrate elements, writ large. The contrary, holistic, stance is to view the qualities of phenomena at one level as emergent at that level, and to assert that an entity can be understood as a product of the inter-relations between its component parts. We have, then, a pair of contrasted approaches: a polarity which is productive in the study of schools of thought, of competing methodologies, and of rhetorical strategies in economics.
